Affidavit of Truth
On or about 6/05, I, [redacted] and Vera Peskan, went to the Bartow Sheriff Dept. in Polk County, Fl and asked to speak to an investigator concerning the issue of obtaining a report and/or investigation of crimes committed against Vera Peskan and her being denied the right to enter her home at 223 Doe Dr. Davenport, Fl. 33837. We asked if a report would be made in behalf of the assault and battery committed against Vera for locking her out of her home at said location We were informed that they had an abandonment placed upon her, since she had been gone over two months. The abandonment of her home was not a true statement. We did ask to speak to a higher ranking person in law enforcement. We were told to go upstairs and spoke to a detective. Hew took us to a small room, whereupon he became hostile, threatened to have Vera arrested if she did not stop talking about her needs for a report concerning the alleged abandonment of her home. At that time we did fear our freedom was in jeopardy. We were only able to tell him that our constitutional rights were being denied by the entirety of the Polk Co. Sheriff Dept. upon which he screamed at us “Go ahead and sue, everybody else does!” With that, we made our exit. Nothing was resolved. Getting no answers, Vera attempted the same scenario at the Winter Haven Sheriff Dept. We were sent to the office of Deputy Susan Weiss. She informed me and Vera that her case was closed, as she had abandoned her property. Vera told her she had warranty deed in her name only and a Domicile, at that present time and at this present time, 5/13/2007. The utilities remain in her name only. Vera informed Dept Weiss that an attorney from legal aid explained to Vera, that this was her home and she could enter any time she chooses. Dep. Weiss stated she ‘did not have to listen to any attorney from Legal Aid, that what I say goes’ and were told to leave immediately. She, Vera still tried to tell the deputy she was incorrect and not a lawyer and could not render a legal judgment. She, the Deputy, then summoned re-enforcements to have us removed and possibly placing Vera in jail. I explained to Vera I am seeking public office and cannot jeopardize my campaign and we will have to find another way to get the truth known and stop this corruption of the Polk Co Sheriff Dept. and judicial system. Two days later they, the same Deputies, unlawfully arrested Vera. Upon Vera’s release, I accompanied her to the Public Defender in charge of her case, Ms. Rouchell and asked her to show me the order for Vera’s arrest. She stated that there was one, it was only misplaced. She did not return for at least 20 minutes. When she did return, she was shamefaced, never looked either of us in the eye and stated, “I spoke to the Judge and charges have been dropped. You do not have to appear in court”. No court order was found against Vera Peskan.
