WHEREFORE as per court record, Judge Harvey A. Kornstein denied the
person of Adam Umholtz his Constitutional rights to the sanctity of
family, due process of law, obstruction of justice, oppression under
‘color of law’, by stating on record, “He did not care that the
Dept. of Children & Families have failed to obey their own contract,
only that he (Adam Umholtz) would be held to the
contract.
THEREFORE, this is a breech of the Civil rights of Adam Umholtz, and an
impeachable offence on the part of Judge Kornstein for violating his
oath of office.
WHEREFORE, this is an unfounded, third-party allegation, of abuse and
prima facie evidence in the testimony from each of the Umholtz
children of the (as they themselves say) unwarranted removal of them
from their home, They speak of the love they have for their mother
and father and the fact that the DCF has placed them a
life-threatening situation with foster people that have a suicidal
twenty-two year old son, who screams all day and threatens to
commit suicide, whom DCF declared acceptable, as an interim
care-giver, while the foster people went on a week-long vacation.
The children speak of absolute fear for their safety, alcohol
abuse, (the parents neither imbibe nor smoke), the use of themselves
as slaves in among other things: ordered to bring alcohol to the
foster people, a/w/a acquaintances of the twenty-two year old son
of foster people..
The abuse heaped upon these children for over a year, is unconscionable .
Judge Kornstein has issued TERMINATION OF PARENTAL RIGHTS in favor
of Dept. of Children & Families, who, we are informed, are paid
$50.000,00 per child by Government funding of Human Trafficking.
THEREFORE, it would behoove any and all working in a capacity as a PUBLIC
SERVANT, to act immediately to the Disqualification of Judge Harvey
A. Kornstein, to
render moot any and all orders until proper investigation is
conducted. Pursuant to United States federal law,” Misprision of
Felony” is still an offense under United States federal law after
being codified in 1909 under 18 U.S.C § 4.
THEREFORE, we, as Citizens Demand moot all orders and immediate
evidentiary hearing, to force DCF to produce evidence with merit,pertaining to
alleged parental neglect and/or abuse.
WHEREFORE, I make this suggestion to you as follows: If the government
has resources to pay a non-familial $600.00 per month for one child,
give that same money to a family suffering from the failing economy,
to more appropriately facilitate in providing a home-style that is
found to be acceptable by our peers

On Tuesday, September 16, 2008, I, Vera Peskan, domiciled in Polk
County and an acquaintance, Pearl. Lanier Bryan, of Polk City, Fl.
did attend a supervised visitation conducted weekly for two hours to
the parents, Mr. & Mrs. Adam Umholtz and their children, Hanna,
Daniel, Steven, Ben, Marilyn, Jennie, Ariana, Zack, Tahlia These
eight children were removed from their home by Dept. Of Children &
Families by an unfounded third party accusation of neglect
2. We went merely to visit with the children and while
there, took video of them for their parents, who will no longer have
parental rights, as of October 6,2008.
3. The story that the children relayed to us, was one of
horror. They are begging to go home to their parents and cry for
help from the abuses they suffer at the hands of foster care and
asked the U.S. American Citizens to please help them to be freed
from torment and other travesties perpetrated against them by DCF.
4. Not one child, had un unkind word directed towards either
parent and informed us that a drunken neighbor made unfounded, false
allegations against the oldest daughter, which led to DCF
destruction of this family unit.
5. Since the visit and video, DCF has virtually placed the
children under lock and key and are performing
institutional child abuse and have called an emergency hearing
without provocation, in order to obfuscate and cover-up the
testimony that will be used in court, made by the children, without
any outside influence.
6. They Judge Kornstein and DCF, appear to be threatened by
the cries of the children, for intervention. This entreaty is to
stop this abuse by Judge Kornstein, appearing to be in ‘collusion
with Department of Children and Families in their relentless pursuit
of eight beautiful, saleable/adoptable blue-eyed, white children.
7. Openly and duly noted in court record, Kornstein states
that DCF does not have to comply with any contracts, only the
parents.
8. These children are now prisoners of Devereaux, who
employ known child molesters, as court records and
newspaper accounts substantiate. These children are now in danger
of ‘disappearing’ as have hundreds of others, while in the control
of this most evil corporation.
Lastly, and most importantly, no female was at the scene of
visitation. Upon seeing an old man with a calculated grin on
his wrinkled face, gleefully, place the little girls in his truck,
we were appalled that he was allowed, without a female supervising,
to be in complete control of these helpless beautiful children.
We were concerned about where he may be taking the children and
began to follow his truck.
To our
horror, he appeared to be heading straight into the woods.. We
were gripped with fear for the little children. That is the only
reason we followed.
Korstein
used this against the Umholtz family, saying we had endangered the
children.
The
endangerment is from DCF, who would allow unlawfully for three giant men to be in complete control of these children
This is
cause for tort action against Devereauz and Kornstein..

this a Constructive Notice of Action.
FURTHER, We, Pearl Lanier Bryan and I, were verbally
threatened with arrest for filming the last family get together, of
the Umholtz family, ON PUBLIC PROPERTY!

10. Larceny by False Promise and Undue Influence
Upon being named guardian, Betty Dugan took Oath to our mother
to see that I had a paid for home, and never have financial
hardship and the rest of the money was to be put into the hands of
the “ministry”, Trinity Christian Ministries, Inc.
Upon the appointment of
‘guardian’, the duo of Dugan and Carpenter, had a ‘re-evaluation’
to declare the person of Vera Peskan, ‘Competent’. They created a
‘will’ for the formerly incompetent, intestate, to sign her estate
to the ministry of Trinity Christian Ministry’. See Exhibit G
Fraud upon the court. Upon gaining control of
the estate, my property, was, ‘under color of law’, transferred
into the estate as a holding of the deceased, by the same
entities, Dugan and Carpenter. The mortgage was ‘satisfied’ by
said estate. See Exhibit H
The property in question was then
transferred back into the name of the Plaintiff. See
Exhibit I.
I, the Plaintiff, became the
primary care-giver to our mother. She was on her death-bed when we
arrived, but after the Defendant’s wrestling of the guardianship
from the court-appointed group, with my care, she regained some of
her strength. The co-horts of the ‘ministry’, most of which are
attorneys, had Vera’s trust put entirely in Betty’s hands. Mike Garlington, of Northern Trust, an attorney and
‘ministry partner’, against his better judgment,
put all the monies and holdings, solely in the hands of Betty Dugan,
which he stated ‘was unlawful and he wanted to ‘wash his hands’ of
the transactions’. Material Witness For Subpoena
Within months, in fear that my
children would interfere with plans and influence me to not give up
my inheritance, (they all reside in Tallahassee, Fl., where my
mother resided), Betty moved my mother to my home in Davenport,
Fl. The abuse, which was in the form of ridicule, debasement, sleep
deprivation, lack of privacy, alienation, deception and complete
control, was continual. Material witnesses to abuse and control, to
be subpoenaed and are also in the form of notarized statements. Exhibit J

was the fraudulent Quit Claim Deed referred to by the Defendant as a
WARRANTY DEED. While under duress and undue influence and
subsequently of ‘diminished capacity’ the instrument, with
fraud on its face, was put before the Plaintiff. . Without ‘meeting
of the minds’, no mutual assent and
misrepresentation. see Exhibit K & B
Assault and Battery
upon my granddaughter, Dulcie Porter, while on my premises. Threats
upon the life of my granddaughter by slapping, punching and
physically throwing her off my property, were also perpetrated by
the Defendant. Her threat was “Your Grandmother owns nothing
here! It all belongs to me and my MINISTRY! I have connections from
here to Washington, DC and can make anyone disappear, and will!” See Exhibit L
Assault and
battery was committed against me and I was physically
thrown from my home, my entrance to it was barred by Jerry Hendrix,
the Defendants’ hired-man. She ordered him to install dead-bolts
and change all locks.. My possessions were thrown to the street.
Material Witnesses: Jerry Hendrix and Mike
Hamilton, who was, at that time, a renter of mine.
With threats that the
group of attorneys, Joy Carpenter and Starla Caldaron, of Joy-Star
PA. would have me seized and Baker Acted, as well as given shocks
treatments, I left, in fear for my very life and freedom.
My home was paid off
by the estate, as promised. No money was allotted me from
the estate, as promised and I was reminded daily that I
should be grateful, because I certainly was not worth anything and
that I had never had anything before they came into my life. After
a while, I actually succumbed to the verbiage used against me
daily, that I was a ‘psycho-babbler’ and accepted all as my

I saw your video. I have filed many
complaints against the cops, lawyers and judges in my
state. Your problem is you do not know whom you are to
file a complaint with. It is important you file a
complaint against the judge with the Judicial review
board and the lawyer's professional responsibility board
(the judge is still a lawyer) and every single lawyer
present. You then take the complaint and carbon copy
(cc:) it to your County Commissioners. This part is
essential. You cannot omit this part.
To file a complaint against your Sheriff's department
you must file a complaint with the police department and
vice versa. You can just write up a letter and send it
off to them you do not need to go to get harassed there.
Again it must be cc: to the County Commissioners. If you
file a complaint against the police it must go to the
mayor. Personally, I would file a complaint with the US
Attorney for your district and cc: as described above.
Also your state probably has a licensing board for cops.
You need to find this out and send a cc: to them also.

A CBS undercover reporting team went into 38 police
stations in Miami-Dade and Broward Counties in Florida,
asking for a set of forms they could use to complain
about inappropriate police behavior. In all but three of
the stations, the police refused to give them forms.
Some of the cops threatened them (on hidden camera, no
less) -- one of them even touched his gun.
officer: Where do you live? Where do you live? You have
to tell me where you live, what your name is, or
anything like that.

Why are Jerry Hill, Sheriff Grady
Judd, Judge Roger A. Alcott, Chief Judge Langford covering criminal
'theft by conversion' committed by the law firm of Joy-Star PA,
Kissimmee, Fl. 34741, for the self-admitted felon, money-launderer and
drug trafficker, known as Betty Dugan, a/k/a Elizabeth Trinity, Peskan,
etc.
Hill in record, states that Dugan is a 'victim'
for bodily ejecting me from my home, that I own in fee simple, with
Warranty Deed to said property.
Jerry Hill's victim,
Dugan, while living on my property, did physically assault and threaten
the lives of my Granddaughter, Dulcie Porter and my great
Granddaughter, Sierra Porter, about three years of age, at the time.
Dugan called the little child filthy names because the child was
terrified of her. Children can sense evil. See record
of Betty Dugan's abuse of minor children. ```
They were literally slapped punched, pushed and thrown into their car,
by Dugan, from my home, in my presence, with threats to their
lives, screaming "I have connections all the way to Washington, DC,I canand will make anyone
disappear!!! This property does
not belong to your Grandmother, it belongs to me
and my ministry!!!
(By ministry, she means Joy
Carpenter and Star
Caldaron, Joy-Star PA.) Keep your nose out and do not
come back. I will have you arrested."
The Sheriff Dept., Dep. Susan Weiss, refused to
take report or make record of this abuse, also. Sheriff Grady Judd is at
the beck and call of the felon, Dugan. Material fact witness to the
above in court record.
To reference
my cowardice in allowing this criminal attack
on the only family to come to my defense: in court record, I am deemed of
'impaired will'. I was in fear and totally under Dugan's control.
This was done to prevent my family from
attempting to find out what was happening to me, since all communication
with them was intercepted and/or destroyed, all mail was sent back,
phone calls were answered by Dugan, stating that Vera did not want ant
further communication with them.
For over four years,
Sheriff Grady Judd, Jerry Hill, judiciary, have been repeatedly informed
and request for assistance has fallen on deaf ears. Not one
answer. No charges brought. No investigation. No
material fact witness were contacted to substantiate all criminal
allegations..
In court record, Dugan perjures herself and calls my Warranty Deed , hers.
My bloody name is on the deed, with Drivers License as ID. What
kind of brainless bastards are running the courthouse and state
attorneys office? I have at least 7 or 8, court recorded perjury, on
this bitch.
I will see that charges
are brought on Grady Judd, Jerry Hill, her attorneys, Joy Carpenter, Star Caldaron and
C. Michael Magruder, for 'obstruction of justice' & Collusion-aiding and
abetting in commission of a felony, by 'vicarious liability'.
In affidavit from his 'victims rights staff,
Hill
states that "anything he and his staff can
do toassist heragainst me,

document. To get the record straight, I have
never had a court order, abuse charge or any other criminal charge
brought against me, Vera Peskan. Their plan was as follows:
Jerry Hill sent a
detective from Bartow Police Dept. to a hearing concerning my Quiet
Title action ongoing for over four years, on my ownership to property, to set me up
for arrest, in behalf of Dugan. The detective told me he was
there for Jerry Hill. I thought the son-of-a bitch was her new
attorney. I only attained the letter identifying Dugan as a
victim through a private investigator, at a later date. He
informed, me, in front of material fact witnesses, he was there on
business, for Jerry Hill. They were hiding their mouths as they spoke together,
all the while, looking at me!! She attempted to anger me
into accosting her, then he would arrest me. My friends told me to
ignore the fat bitch. I did!
I had Yancey, the judge,
disqualified for 'want of diligent search' and 'fear of prejudice'.
Then dugan again attempted to have me meet her across the street.
I, once again, ignored her come on.
The following is sufficient, along with other
hundreds of equally egregious complaints of malfeasance, lack of
prosecution and outright victimization of the victims, with which Jerry
Hill, state attorney, operates 'under color of law.
On the other hand this known felon, Betty Dugan,
who turned states evidence against all the judiciary and other scum-bags
of her era, 1979-82, was charged with the horrific abuse of two minor
children, as well as other charges of abuse. Links to be posted on all
court documents.
She was proven in a
court of law, to be culpable in a wrongful death action which the mother
brought against Dugan. This suicide while under the influence of
cocaine, was the person Dugan had as a sex partner, while her
husband was in jail for about 7 years. Maybe he, the abused
kid, got the
mental picture of the sex while high and couldn't take it.

Her husband,
non other than the always cheerful Bob Dugan, took
the heat for the money-laundering and drug-running. She spent the
money, had a ball and balled. Everyone suffers at the hands of the
person known as Betty Dugan, a/k/a Trinity, Elizabeth.
Attorney General, Bill McCollum,
when informed by the Dept. of Legal Affairs of the lack of prosecution
and criminal activity of the above referenced, sent his Staff as Defense
Council to protect all the above, rather than prosecute them.
This is all referenced in 'Melvin
Horne Appeal". The largest bust ever, in this state brought her
and her husband down as well as notables in the judiciary, many elected
officials, etc. Where were Jerry Hill and Bill McCollum when all
this went down? Could make for an interesting discovery on their

The
following Warranty Deed that proves I am the owner in fee simple
(sole ownership) of the property that the Sheriff, Grady Judd has been
told to keep me from entering, by the person known as Betty Dugan, a
self-confessed felon with underworld ties, that is well documented.
She and
her husband, Bob Dugan were brought down in the early 80's by an FBI
sting, for drug-trafficking and money laundering. They were the
biggest ever, in this state. All their clients and co-horts were
none other than the top bananas of judiciary -attorney, Melvin Horne,
Mallory Horne, (former speaker of the House, Florida) Does that give
rise to suspect that they are still operating in concert with her
money-laundering? The court record states that she and her husband
had numerous off-shore accounts. They could not find all of
them. This thief has many a/k/a's as she is well-versed in fraud.
My name is also on a car she owns and I cannot get it removed.
What's worse is, what else has she assigned to me that jeopardizes my
safety and properties?
Court record show that she has many
judgments against her in the hundreds of thousands. That is why
she and her cult, conned me into giving everything to her. She
cannot own property in her name, therefore they created a cover known as
Trinity Christian Ministries.

by DCF which, at the time, pissed me off, now I realize after four years
out of their control, that I am! Who in their right mind would

Carpenter, as

Betty Dugan a/k/a Trinity, Peskan,
Elizabeth perpetrated the following:
Started a not-for-profit "religious"
organization wherein she charged several thousand dollars for Tarot card reading
and fortune telling.
Co-habitated with and put Joy Carpenter through law school to
have permanent legal representation that she could control.
Engaged in illegal sexual relations with a 12-year-old boy
for several years -- leading to his suicide by gunshot at her
kitchen table while under the influence of cocaine. (Wrongful Death Judgment)
Enslaved a vulnerable senior citizen (Vera) and unlawfully
exploited me from my rightful inheritance of over &700,000,00
a/w/a conversion of my property, worth over $200,000.00, by
converting it to the deceased, my mother's estate.
This
was accomplished due to my name and my mother, being the same,
Vera Peskan. The cult placed my property into the coffers
of Trinity Christian Ministries. This was perpetrated by
Joy Carpenter with the assistance of second vice president of
Northern Trust of Sarasota, Fl. Mike E. Garlington, who
transferred, unlawfully, cash withdrawals of over $20,000.00 at
a time, into the hands of Betty Dugan. Garlington, a
tithing member of the cult, was in direct conflict of interest'
'Collusion to defraud, etc.
Banking Commission to be apprised with upcoming banking
records.
1) Unlawfully, overturning state
assessment of mental incompetence of my mother, to declare her
competent in order to have Carpenter draw up a bogus will,
leaving the entire estate to Dugan' and her attorney's
'ministry'. Mother was intestate, therefore, we should
have had an equal share of the estate.
2) Coercing me into signing, with
no meeting of the minds, all rights to inheritance.
3) Betty Dugan's attorney (Joy
Carpenter) with fiduciary interest (TCM administrator) drew up
the papers (and had a financial interest in said transaction).
4) Betty Dugan 's attorney (same)
signed as a witness and created fraudulent quit claim.
5) Betty Dugan's attorney (same)
signed as the notary (and had a financial interest in the
transaction).

6) Betty Dugan immediately whisked Vera out of state for
three days so she could not be available to rescind her
signature if she had figured out what was happening.
7) Shortly thereafter, Betty
Dugan, threatened Vera with Baker Act, to be picked up by the
Sheriff, placed in constraints, given shock treatments, with
which Vera ran and hid. Upon returning to her home Dugan
and her handyman physically threw Vera out of her own home, changed
locks, and threw her possessions to the street, instructing
Jerry Hendrix, the handyman, to keep any of the items he wished
for himself. Material witness to this is the person Mike
Hamilton. (Also, never investigated.)
8. John Flynn was directed by Betty Dugan to take
her property to his house in Ormond Beach and not return it to
Vera.
Note: there are more than four or five fraudulent transfers by means of
guardianship, Trust Transfer, executed by by
Trinity Christian Ministry tithing member, by the name of
Michael E. Garlington, Trust official for Northern Trust, Sarasota, Fl.
9. Persons of 'impaired will'
cannot be bound to contract. This law is to
prevent people like Betty from exploitation of people like Vera. The fact that this was
done in full concert with Betty's law firm, (property purchased
with the proceeds of Vera's share of inheritance. Joy-Star PA,
Kissimmee, Fl. (in and through her "ministry") is more than
sufficient reason to disbar all involved attorneys for life.
The sheriff of Polk County, cowboy Grady Judd, defended Betty
Dugan's actions to the point of illegally arresting and
imprisoning Vera for three days, without charge, without
warrant, without legal cause, without paperwork.
All of the above has been submitted by a Private Detective

Justice demands a new trial

In reviewing a murder conviction for which there
now exists profound evidence of innocence, Polk
State Attorney Jerry Hill seems remarkably detached.
Confronted with a disturbingly detailed account of
how his office may have prosecuted the wrong man for
the 1987 murder of Michelle Schofield, Hill turned
to the very prosecutor whose work was in question.
"I asked him if there was anything in the article
that he wasn't aware of, that was new to him, and he
said no," Hill said. "I dare say that you take any
homicide that is 18 years old and evaluate it today,
and there will be things that weren't known."
That's it? Ask the prosecutor whether he erred,
and then shrug your shoulders when he says he
didn't? Leave it to a defense attorney to try to
sort out the truth?
The case of Leo Schofield demands considerably
more of our justice system. He has spent nearly 19
years in prison after being convicted of murdering
his wife, but, as Times staffers Meg Laughlin and
Don Morris revealed in a sobering investigative
report last Sunday, a mountain of evidence points to
another man.
- Fingerprints found in the victim's car were
never identified at trial. Now we know they belong
to Jeremy Scott, who has a history of violence, a
conviction for murder and who lived within 2 miles
of where the body was found.
- Hill's chief prosecutor dismissed the value of
the fingerprints, saying Scott would have stolen the
victim's jewelry. But in two other murders for which
Scott was charged, Laughlin found that he left
fingerprints and jewelry in both cases. He was
convicted for one of them.
- The prosecutor's chief witness has changed her
story. The woman, who lived in the same trailer
park, claimed to have seen Schofield carry his
wife's body to his car. But her husband told
Laughlin: "No way (she) could've seen and heard from
that little bathroom window what she said she
heard." She in turn changed her story when asked by
Laughlin. The woman has spent time in mental
institutions for symptoms of delusions.
- Law enforcement versions of witness statements
don't match what the witnesses told Laughlin. One
Polk detective testified at trial that he knew of no
other cases where women had been similarly stabbed,
though at the time three unsolved murders fit the
profile.
Schofield, who had no prior criminal record, has
maintained he was innocent since the day he was
arrested, and he rejected a plea deal before trial.
His new attorney, Richard Bartmon, has asked Polk
Circuit Judge Dick Prince to grant a new trial. The
fingerprint evidence alone justifies it. The
recanted and false testimony make it imperative.
Bartmon knows, though, that new trial requests
are rarely granted after so much time has passed.
That's why it is especially disappointing that Hill,
who has a statewide reputation as a fair prosecutor,
is refusing to consider the possibility that his
office made a mistake.
In its formal response to the motion for a new
trial, Hill's office argues that the original
defense attorney failed to exercise "due diligence"
in pursuing the identity of the fingerprints
connected through drug trafficking and money
laundering.
